By agreeing attend any program or access any data, social media platform, message on any platform  or information provided or broadcasted by Malkans Training Institute Private Limited (“Malkans” or the “Institute”) or mentors, you confirm that you have read these disclaimers and waivers and hereby agree, acknowledge and confirm that:

1. Any and all information provided by Malkans is educational information solely designed to guide on personality development, technical analysis and market psychology using various information and materials including past real-life examples.

THE GUIDANCE PROVIDED BY THE MENTORS IN ANY FORM OR MANNER DOES NOT GUARANTEE OR PROVIDE COMMITMENT ON THE IMPROVEMENT OF PERSONALITY AND ALSO DOES NOT CONSTITUTE ADVICE OR RECOMMENDATIONS OR GUARANTEE OR INVITATION OR ENCOURAGEMENT TO BUY, SELL, TRADE, OR INVEST IN STOCKS. TRADING IN STOCKS INVOLVES SIGNIFICANT RISK AND PAST PERFORMANCE DOES NOT GUARANTEE FUTURE RETURNS OR RESULTS. THE TRADING INSTRUMENTS PRESENTED IN THE DATA ARE NOT TO BE CONSIDERED A RECOMMENDATION TO BUY OR SELL OR TO ENSURE ANY KIND OF GUARANTEED RETURNS.

You understand that the guidance received by you in any program or platform is not offered as a substitute for professional mental health care or medical care and are not intended to diagnose, treat or cure any mental health or medical conditions. You also understand that the mentors at any given time are not acting as mental health counsellors or medical professionals.
5. You understand that the materials presented by the mentors or Institute are trade secret information and protected under various laws including the copyright laws of India.

Unauthorized forwarding, copying, or reproduction of any kind will be treated as a breach of copyright. In addition to these terms above and below, you agree to read and be bound by any additional terms presented to you. PHOTOGRAPHY, SCREENSHOTS, VIDEO RECORDING, OR AUDIO RECORDING OF ANY KIND ARE STRICTLY PROHIBITED.

6. All Participants should consult a qualified professional before taking any financial decision basis the information and materials provided by the Institute or any person associated with it. Any information provided by the Institute or any person associated with it has been obtained from sources deemed reliable but is provided on an “as is” basis and the Institute or any person does not make any warranties, whether express or implied, statutory or otherwise, including without limitation warranties of merchantability, fitness for purpose, non-infringement, completeness or accuracy. Any information provided is made available to the Participants in general and at large and without regard to the investment goals, personal traits and individual personality, financial circumstances, investment knowledge, and the abilities or personal attitudes of the Participant towards investing or trading abilities. No information provided shall be treated as an investment advice or research services.
7. Participants can and do lose money from investments and trading. The information provided in the data is not to be relied upon for the investment decision of the Participant.

8. You agree to hold Malkans and the mentors completely harmless for any loss or damages arising due to information and materials provided to the Participant. In no event will Malkans and/or the mentors be liable for any trading losses, direct, consequential, nominal, special, indirect, exemplary, or punitive damages, whether in contract, tort, or any other legal theory, in connection therewith, suffered by the Participant or any client of the Participant as a result of or arising out of enrolment your attendance at and participation in the Event.
9. Malkans’ owns exclusive rights to all its contents for education services provided and shall be deemed to be the Intellectual Property of Malkans’. The Participant certifies that it/he/she is not a competitor or related to the competitor or engaged in any similar business as that of either the mentors or Malkans.
10. The participant here waives the opportunity or right to inspect or approve any such copy, text, proofs, negatives, tests, finished films, videotapes, audiotapes, digital images or recordings, and photographs or the uses to which the same may be put. All copies of your image, likeness, and voice created or recorded by you or your designee hereunder shall be the sole and exclusive property of the Institute including any prints and negatives depicting the same.
11. You are aware that there are no refunds and no guarantees are being assured under any events or programs or platforms organised by the Institute.
12. THE INSTITUTE DOES NOT BELIEVE IN GET-RICH STRATEGIES AND PROGRAMS – ONLY IN HARD WORK, ADDING VALUE, BUILDING A REAL AND PROFESSIONAL CAREER, AND SERVING OTHERS WITH EXCELLENCE AND CONSTANCY. ANY INFORMATION OR MATERIAL OR DATA IS INTENDED TO PROVIDE DETAILS, INFORMATION AND MATERIALS RELATED TO DIFFERENT METHODS OF TRADING AND THE SAME SHALL ONLY BE CONSTRUED FOR ACADEMIC/KNOWLEDGE PURPOSES.
13. Any financial numbers, including any testimonials from their past/present Participants referenced here, or on any of our websites or social media platforms, are illustrative of concepts only and should not be considered average earnings, exact earnings, or promises for actual or future performance. Making decisions based on any information presented in the Institute’s products, events, services, or website should be done with the knowledge that you may experience risk or losses just like an entrepreneurial endeavour.
14. These terms will be governed by and construed in accordance with the laws of India. You hereby agree that any dispute that arises out of or relates to these Terms will be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996 arbitrated in Mumbai by a sole arbitrator to be appointed mutually by the Parties. If any of these Terms are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms of use and will not affect the validity and enforceability of the remaining provisions.
15. You hereby warrant that you are eighteen years of age or older, that you are fully competent to execute this agreement, and that no other agreements currently exist which would prevent you from accepting these terms.
16. You have read and understood the contents of these Disclaimer and Waivers and you are executing it of your own free will.
